1. Booking Terms and Conditions
Upon payment of a holding deposit that is equivalent to one week’s rent and submission of the booking application, a room offer email will be sent to the applicant. Applicant is required to accept the room offer and formally enters into a tenancy agreement with dwell. A bond payment, amounting to 4 weeks’ rent, is also required to be paid within 5 business days from the issuance of the room offer email. This bond payment is lodged with the CBS (Consumer and Business Services) in accordance with the Residency Tenancy Act.
The holding deposit paid will go towards the initial rent payment once the applicant checks into the property.
Payment of holding deposit and submission of application does not guarantee a room allocation. A room offer will be sent within 3 working days from your application submission. Your reservation is not confirmed until you have received and accepted our room offer. If your room is not available, your holding deposit will be refunded in full. To withdraw an application, you will need to submit your intention to withdraw in writing to us at StayEastEnd@dwellstudent.com.au.

2. Cancellations received before the commencement date of the signed Residential Tenancy Agreement
a) Below Terms and Conditions do not applies to replacement tenant taking over a tenancy agreement from a current tenant. Please refer to Section 5 for cancellation of the replacement tenancy agreement before the commencement date of the tenancy agreement.
b) Cancellation requests must be submitted in-writing via e-mail to StayEastEnd@dwellstudent.com.au
i) Cancellation is submitted to dwell no later than 14 days BEFORE the agreement’s start date
The holding deposit fee will be forfeited by applicant to dwell East End.
ii) Cancellation is submitted to dwell 13 days or fewer BEFORE the agreement’s start date
c) Applicants are responsible to find their own tenancy replacement. Residents are responsible for rental payments according to the Residential Agreement for the whole period of their agreement or until such time as an approved replacement is found (whichever comes first). dwell East End is obliged to fill rooms that are already vacant before newly departed rooms can be filled, following a queue.
d) dwell East End must approve all replacement tenants. Replacement tenants must be students from a higher education institution and cannot be existing tenants with whom dwell East End already holds an agreement.
e) dwell East End reserves the right to recover reasonable costs (included but not limited to cleaning, advertising, administration costs and loss of rent) for agreement cancellation and early termination from the holding deposit or bond payments until a replacement tenant is found.
3. Cancellations received after the commencement date of the signed Residential Tenancy Agreement
a) Below Terms and Conditions applies to both original tenants as well as replacement tenant taking over a tenancy agreement from a current tenant.
b) Cancellation requests must be submitted to dwell by completing a ‘Notice to Leave by Tenant’ form which is available upon request at the reception
i) Cancellation is submitted to dwell AFTER the agreement’s start date regardless of whether applicant has checked in or not
c) Applicants are responsible to find their own tenancy replacement. Residents are responsible for rental payments according to the Residential Agreement for the whole period of their agreement or until such time as an approved replacement is found (whichever comes first). dwell East End is obliged to fill rooms that are already vacant before newly departed rooms can be filled, following a queue.
d) dwell East End must approve all replacement tenants. Replacement tenants must be students from a higher education institution and cannot be existing tenants with whom the dwell East End already hold an agreement.
e) The outgoing tenant should allow at least 3 working days for cleaning and maintenance to be done after their departure and prior to the contract commencement date of the incoming tenant. Rent for such time is payable by the outgoing tenant to dwell East End prior to departure.
f) Departing tenants are required to complete a Bond Claim Form prior to departure. Bond monies will be processed on the updated end date of the current Residential Tenancy Agreement, subject to apartment inspection following dwell East End Rules.
g) On the day of departure, room key is to be returned to Reception prior to 10:00am. Keys returned after 10:00am will incur additional charges unless prior arrangements have been made with dwell East End Administration.
h) dwell East End reserves the right to recover reasonable costs (included but not limited to cleaning, advertising, administration costs and loss of rent) for agreement cancellation and early termination from the holding deposit or bond payments until a replacement tenant is found.
4. Cancellation of Tenancy Agreement – Due to no Visa (International Students)
a) As an eligible international student (students coming from abroad), applicant can enter into a Residential Tenancy Agreement at Dwell East End, knowing that applicant have the option to terminate their agreement with limited liability under the following conditions:
i) Full refund of holding deposit and bond
a) Notification of visa rejection is provided to dwell East End within 24 hours of receiving the decision from the Department of Immigration.
b) A duly completed cancellation form is submitted to dwell East End no later than 14 days BEFORE the agreement’s start date.
ii) Forfeit of holding deposit and *partial refund of bond
a) Notification of visa rejection is provided to dwell East End
b) A duly completed cancellation form is submitted to dwell East End 13 days or fewer
BEFORE the agreement’s start date.
* $250 administrative fee is charged and deducted from the bond.
iii) Forfeit of holding deposit and bonda) Notification of visa rejection is provided to dwell East End
a) A duly completed cancellation form is submitted# to dwell East End AFTER the agreement’s start date.
#Note: Failure to inform dwell East End of cancellation will result in rent being charged to the applicant
until a suitable replacement is found. If applicant does not check into the dwell East End on the
agreement’s start date, dwell has the right to terminate the agreement and reassign the room to another
applicant.
b) If Visa status is not known by the agreement’s start date, applicant is required to inform dwell East End. Holding deposit will be used to cover for the room rent. Once the holding deposit is unable to cover the room rent, contract will be deem as terminated and room will be reassigned. Bond will be forfeited to dwell East End.
5. Cancellations received before the commencement date of thsigned Residential Tenancy Agreement of a replacement tenant
a) Cancellation requests must be submitted in-writing via e-mail to StayEastEnd@dwellstudent.com.au
i) Cancellation is submitted to dwell 14 days BEFORE the agreement’s start date
ii) Cancellation is submitted to dwell 13 days or fewer BEFORE the agreement’s start date

e) dwell East End reserves the right to recover reasonable costs (included but not limited to cleaning, advertising, administration costs and loss of rent) for agreement cancellation and early termination from the holding deposit or bond payments until a replacement tenant is found.
6. Cancellation by dwell
a) dwell will cancel any incomplete application submitted via our online application portal that has past the given timeframe for completion. In such case, dwell may charge an administrative fee and/or retain any holding deposit and/or any other amounts you have paid to us.
b) At any time during or prior to the commencement of your residential tenancy agreement, dwell East End may (at our complete discretion, but otherwise to the extent permitted by the law of the Relevant State) cancel your booking if any of the following occurs:
c) In this case, to the extent permitted by the law of the Relevant State, we may retain any holding deposit and/or any other amounts you have paid to us.
7. CONTRACT DEFERMENT
a) The management team will review each deferment request on a case-by-case basis. Management reserves the right to approve or deny any deferment request based on the provided documentation and the merit of the case.
b) Students must submit a deferment request in writing at least 14 days before the lease commencement date with comprehensive supporting document.
c) The first deferment will be free of charge, but any subsequent deferments after the commencement date will incur a $250 administrative fee.
